Award crimes
Before one can speak of an award crime, 4 legal conditions must be present.
- First, there must be an obstruction or disruption of a liberty, bid or tender.
- In addition, it must be "an assignment" relating to ownership, usufruct, lease of property and real estate, a contract, a supply, a business or any service. One can speak of an allotment if the tender, tender or sale is made under the supervision of a public official.
As a third condition, the crime must be done by one of the means listed in the law. In Article 314 of the Criminal Code, the legislature appoints means by which the crime must occur before it can be criminalized.
- Violence or threats
- Donations or pledges
- Fraudulent means
Finally, general intent is required for this crime. Any act is deliberately done to prevent, disrupt or impede the conduct of the entry.
Crimes in this context are punishable by imprisonment from 15 days to six months and a fine from 100 to 3,000 euros.
When acted by a legal person, the prison sentence is converted to a fine of 100 to 12,000 euros.
The amounts of this fine have yet to be multiplied by the opdeciemen. Right now, the opdeciemen are equal to 8. (fine amount x8)
