The right to paid vaccination leave is in the works, what do we already know?

The Council of Ministers approved a preliminary draft of the so-called vaccination leave, or in official terms "the law on the granting of a right to minor leave for workers for the purpose of receiving a vaccine to protect against the coronavirus." In other words, as part of the vaccination strategy, the legislature grants workers the right to remain absent from work for the time he/she is vaccinated, and this without the loss of pay.

Based on the text of the preliminary draft, the employee will have to fulfill two conditions in order to claim vaccination leave:

1. Informing the employer in advance

The employee will have to let the employer know in advance when he will be absent. Moreover, he will have to use the leave for its intended purpose. In order to avoid discussions around advance notice, the National Labor Council has asked the government to draw up a concrete and effective vaccination plan so that the employer can be informed as soon as possible about the timing and timing of employees' vaccinations. The organizational and financial impact must be minimized for workers.

2. Evidence of vaccination.

To be granted vaccination leave, the employee will have to be able to prove that he will effectively be vaccinated. Based on the preliminary draft, it would be sufficient for the employee to present the invitation to be called for vaccination.

Specifically 

The employee will be entitled to paid circumstantial leave for the coronavirus vaccination, provided, therefore, that the employee has the prior notify employer AND he did take the leave used for the purpose for which it was created.
